The Position Of The Regional Representative Council DPD In A Half Hearted Bicameral System

Abstract

The amendments to the 1945 Constitution brought about major transformations in Indonesia's constitutional structure, one of which was the birth of the Regional Representative Council (DPD). However, the DPD's constitutional design created an anomaly in the parliamentary system often referred to as "half-hearted bicameralism." This article analyzes the DPD's position and function within the national legislative system and its implications for the principle of checks and balances. Using normative juridical research methods, this study finds that the DPD's limited authority in legislative decision-making has led to its subordination to the DPR. Restoring authority through constitutional amendments or strengthening it through Constitutional Court decisions is necessary to realize an effective bicameral system.
