Abstract

The Land Sale and Purchase Deed is a legal instrument that plays a crucial role in the transfer of land rights in Indonesia. The deed serves not only as authentic evidence but also as the legal basis for land registration, providing legal certainty and protection for the parties. In practice, the process of drafting a Land Sale and Purchase Deed involves public officials with special authority, namely a Notary Public and a Land Deed Official (PPAT). Therefore, the role of a Notary in the deed-making process related to the transfer of land rights is highly strategic because it directly relates to the validity, legality, and evidentiary power of a legal act. Research shows that Notaries play a crucial role in providing legal certainty by drafting authentic deeds that meet the formal and material requirements in accordance with applicable law. This role extends beyond drafting and ratifying the deed, but also includes verifying the identity of the parties, verifying the legality of the documents, examining the status of land rights, and ensuring that the agreement does not conflict with laws and regulations, public order, and morality. Notaries are also obligated to act honestly, independently, thoroughly, and impartially to maintain the integrity and validity of the deeds they create. In the land context, notaries play a role in fostering orderly administration and preventing future legal disputes. This research also found that notaries' authority in land matters is limited due to the division of authority with land officials (PPAT). PPATs have specific authority to draft deeds directly related to the transfer of land rights as the basis for land registration with the National Land Agency. Meanwhile, notaries play a more significant role in drafting preliminary deeds or agreements related to land, such as sales and purchase agreements and power of attorney. Therefore, the authority of notaries and PPATs must be understood harmoniously to avoid overlapping authority in land law practices. In addition, a notary's responsibilities in drafting land sale and purchase deeds include administrative, civil, and ethical responsibilities. Notaries can be held accountable if proven to have committed negligence, violated procedures, or made errors in carrying out their duties that result in losses for the parties. Therefore, professionalism, caution, and adherence to the code of ethics and laws are crucial in carrying out the duties of a notary. By exercising their authority and responsibilities professionally, notaries can play an optimal role in creating legal certainty, legal protection, and public trust in authentic deeds in the transfer of land rights.
